Judge Shopping?  --  See for Yourself

Judge Shopping is discussed in Paragraph  six (6) of this pleading. When you read how the eight (8) Level Propane Bankruptcy petitions were filed, keep in mind that each such filing takes at least seven (7) minutes to process. That means the lawyer that let them in line had to wait almost an hour to finish his filings for his individual clients.

Walter Himmelman

Walter Himmelman was the Chief Financial Officer of Level Propane and one of the initial group to join the October 2000 scheme to seize Level Propane. This boldness was surprising in a man who came to Level Propane from Waxman Industries with an annual salary of $30,000. His role in the scheme is still unclear, but there is no doubt that he was party to the original scheme and reaffirmed his determination to see the scheme through when he wrote to John Rudd in May, 2002, that he would work to see that Bill Maloof  never regained control of Level Propane. When Himmelman wrote to Rudd, he wrote as a long-time client of BFCA to a longtime collaborator with BFCA in its insolvency cases.

Since Level Propane’s going-concern assets have gone into Amerigas’ hands, Mr. Himmelman’s fortunes have improved dramatically: he recently purchased free and clear a multimillion dollar lakeside vacation home in Sandusky, Ohio that he enjoys to this day. Such a property is simply not possible to purchase on the salary of a school teacher and an accountant.
